General Terms and Conditions of PURELEI GmbH

§1 Applicability to Consumers and Definition of Terms

(1) The following General Terms and Conditions apply to all contracts concluded via our online store at www.purelei.com between us, PURELEI GmbH, Gottlieb-Daimler-Straße 10, 68165 Mannheim, represented by the managing directors Alisa Maria Jahnke, Frederik Jahnke, and Etienne Espenner, registered in the commercial register of the Mannheim District Court under HRB 726494, and the customer in their version valid at the time the contract is concluded. Deviating general terms and conditions of the customer are not recognized unless we expressly agree to their validity in writing.

The product offerings in our online store are directed solely at consumers. A consumer is any natural person who concludes a legal transaction for purposes that predominantly are outside his or her trade, business, or profession (§ 13 BGB).

§2 Formation of a Contract, Storage of the Contract Text

(1) The presentation and promotion of goods in our online store do not constitute a legally binding offer by us, but are merely a non-binding invitation to the customer to order goods.

(2) By clicking the "Buy" button in the last step of the ordering process or by clicking the "Pay Now" button when using the "PayPal" payment method, the customer submits a binding offer to conclude a contract for the purchase or booking of the goods and/or services displayed in the order overview (offer).

(3) The order is placed subject to § 6 in the following steps:

  1. Selection of the desired goods and color

  2. Adding the goods to the shopping cart by clicking the "Add to Cart" button

  3. Selection of additional items or viewing the shopping cart

  4. Checking the information in the shopping cart and making any necessary changes

  5. Clicking the "Proceed to Checkout" button

  6. Registration in the online store or express checkout through the payment service "PayPal" (previous registration required) and entering login details (email address and password) or entering contact and delivery address and possibly entering a voucher or discount code

  7. Clicking the "Continue to Shipping" button

  8. Further review or correction of the respective entered data

  9. Selection of the shipping method

  10. Clicking the "Continue to Payment" button

  11. Selection of the payment method and entering the required information

  12. Binding submission of the order by clicking the "Buy" button or, when choosing the payment service "PayPal," by clicking the "Pay Now" button

The customer can, after checking their details and before sending the order bindingly, return to the website where the customer's details are recorded and correct input errors by using the "Back" button included in the internet browser used or by clicking the "Change" button next to the contact details and shipping information, or by closing the internet browser to cancel the ordering process.

(4) We immediately confirm the receipt of the order by an automatically generated email ("Order Confirmation"). A valid contract is only concluded with the shipping confirmation by email (acceptance).

(5) We send the customer the contract text (details of the order), our general terms and conditions, including the voucher and discount conditions, and the cancellation policy, where applicable, by email. The general terms and conditions can also be viewed by the customer at any time at http://www.purelei.com/pages/agb. The order data is no longer accessible via the website for security reasons. If the customer has a customer account, their orders are displayed there.

(6) The customer can place orders in our online store as a guest or as a registered user. As a registered user, the customer does not need to provide personal data each time but can simply log in before or during an order with the email address and password chosen at registration. Registration alone does not constitute any purchase obligation regarding the goods offered by us. Access data to the account must be treated confidentially and must not be disclosed to third parties. (7) The conclusion of the contract is carried out in German language.

§3 Prices, Shipping Costs, Payment

(1) The prices stated include statutory value-added tax and other price components. Additional shipping costs may apply, unless otherwise specified below. The shipping costs are indicated in our price information in our online store. The price including VAT and applicable shipping costs is also displayed in the order form before the customer submits the order.

(2) The customer has the option to pay by PayPal, credit card (Visa, American Express, Master Card), Klarna, and via the internet browser "Safari" Apple Pay, subject to § 6 and § 7 of these General Terms and Conditions. The respective terms of use of the payment service apply. More information about Klarna is listed at the end of the general terms and conditions ("Information on Klarna").

§4 Delivery

(1) Unless otherwise specified in the product description and subject to § 6 and § 7 of these General Terms and Conditions, delivery takes place within approximately 3 to 7 working days (Monday to Friday). The delivery period starts the day after the contract is concluded. If the end of the period falls on a Saturday, Sunday, or a public holiday at the place of delivery, the period ends on the next working day.

(2) Express shipping: Parcels submitted on a weekday by 2 PM are delivered within Germany regularly within 24 hours. Orders placed on a Friday before 2 PM will be delivered the following Monday. Express shipping is not available for deliveries in the Mahina Club subscription.

(3) The risk of accidental loss and accidental deterioration of the sold item also passes to the customer only upon delivery of the item to the customer or in case of default of acceptance by the customer, provided that the customer is a consumer.

(4) In case of delivery difficulties or if a product is no longer carried at the time of ordering, we will inform the customer immediately and refrain from acceptance. We will promptly refund all amounts that the customer may have already paid for the unavailable products.

(5) If we are unable to deliver, we will hold the delivery for up to 10 days in our warehouse. In this case, a notification will be left for the customer, from which the customer can find out where their order is located and how to receive it. If the customer does not contact us within a period set by us to arrange a delivery, we are entitled to withdraw from the contract. We will refund the paid purchase price as quickly as possible, at the latest within 14 days from the date of the withdrawal. In such cases, we are entitled to charge the customer all shipping costs and other costs arising from the termination of the contract as damages.

§5 Retention of Title and Prohibition of Resale

(1) We retain title to the goods until the purchase price has been paid in full.

(2) The customer assures to use the products exclusively for private purposes. Any commercial or commercial resale of the purchased products is prohibited.

§6 Mahina Club

(1) The Mahina Club is an indefinite subscription for the monthly delivery of jewelry and/or accessories. To manage the subscription, the customer can create a customer account after placing the order.

(2) Partly deviating from § 2 (3) of these General Terms and Conditions, the order in our online store is placed in the following steps:

  1. Selection of the desired jewelry color

  2. Adding the goods to the shopping cart by clicking the "Add to Cart" button

  3. Checking the information in the shopping cart and making any necessary changes

  4. Clicking the "Proceed to Checkout" button

  5. Entering contact and delivery address and possibly entering a discount code

  6. Clicking the "Continue" button

  7. Further review or correction of the respective entered data

  8. Selection of the payment method and entering the required information

  9. Binding submission of the order by clicking the "Buy" button or "order subject to payment"

(3) The jewelry color is selected by the customer at the time of ordering and can be changed subsequently until the 28th of the current month for the following month in the customer account or via customer service.

The selection of specific jewelry pieces and/or accessories for the respective month is made by us. The jewelry pieces and/or accessories are available only in one size. An exchange, especially due to size, color, or fit, is excluded. The jewelry for the following month is visible in a preview on our website.

(4) The monthly price for the subscription stated on our website and in the product description includes VAT and shipping costs.

Payment methods are PayPal and credit card. Vouchers cannot be redeemed.

During the term of the subscription, the customer authorizes us to debit the monthly amount for the current month according to the payment method specified by the customer. The monthly debit occurs on the 2nd of each month. The first debit occurs immediately after the subscription is concluded.

If we are unable to debit the monthly amount, no delivery of jewelry and/or accessories will occur. If further attempts to debit the monthly amount fail and a period set by us for payment passes, we are entitled to cancel the subscription. In such cases, we are entitled to charge the customer all costs arising from the termination of the contract as damages.

To change the payment method, a cancellation and re-subscription of the subscription by the customer is required.

(5) Deviating from § 4 of these General Terms and Conditions, delivery takes place within 3 to 7 working days after debiting the monthly amount. The customer receives a shipping confirmation and a tracking number.

Changing the shipping address is possible in the customer account or via customer service.

If we are unable to deliver, we will attempt to contact the customer again after the 10 days during which the delivery is held. If the customer does not contact us within a further period set by us to arrange a delivery, we are entitled to cancel the subscription. A refund of the amount already paid occurs at the latest within 14 days from the date of cancellation. In such cases, we are entitled to charge the customer all shipping costs and other costs arising from the termination of the contract as damages.

(6) Customers have the option to pause the subscription in the current month for the following month. Appropriate settings must be made before the 28th of the current month in the customer account or through customer service. Multiple pauses are possible, but each only for the following month.

When activating the pause, the debit and also the delivery for the next month are suspended. In the month after next, the debit and delivery occur again.

(7) The subscription can be canceled before the 28th of the current month with effect from the following month via our website, in the customer account, or via customer service. After a cancellation, the customer has the option to reactivate the subscription for the following month in the customer account or through customer service.

We can cancel the subscription by the third working day of a month to expire at the end of the next month in text form (e.g., by email).

(8) Customers with an active subscription (ongoing or pausing) have access to pre-sales for certain sales promotions. All information about the respective pre-sales, invitations, and just before the pre-sale, the password for registration in our online store is received by customers by email.

An active subscription (ongoing or pausing) also entitles customers to participate in certain sweepstakes, which we conduct at our sole discretion. The respective participation conditions apply.

Customers with an active subscription (ongoing or pausing) finally receive discount codes for claiming a price reduction on designated items or for acquiring a free item, which we grant at our sole discretion. Our discount conditions and the additional conditions of the respective discount campaign that apply in each case apply.

No claim to the conduct of pre-sales, sweepstakes, or the issuance of discount codes is thereby established.

§7 Advent Calendar

(1) Deviating from § 4 of these General Terms and Conditions, the shipping of orders containing an advent calendar occurs from September to mid-November of the current year, unless otherwise stated.

(2) A cancellation of the order or change of the shipping address is only possible until the date specified in the product description.

(3) A change of the jewelry color is not possible after placing the order.

(4) Payment methods are PayPal, credit card, and Klarna. Vouchers can be redeemed. Discount codes cannot be applied.

§8 Right of Withdrawal

(1) If the customer is a consumer, he or she has a statutory right of withdrawal according to the following cancellation policy.

You have the right to withdraw from this contract within fourteen (14) days without giving any reason.

The withdrawal period is fourteen (14) days from the day on which you or a third party named by you, who is not the carrier, has taken possession of the goods.

To exercise your right of withdrawal, you must inform us, PURELEI GmbH, Gottlieb-Daimler-Straße 10, D-68165 Mannheim, Phone: +49621 87949885, Email: info@purelei.com, by means of a clear declaration (e.g., a letter sent by post or email) of your decision to withdraw from this contract. You may use the attached model withdrawal form, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of Withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in no event will you be charged any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back, or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to us, without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired.

You will have to bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

The right of withdrawal does not apply to contracts for the supply of goods that are not prefabricated and for the manufacture of which an individual choice or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer, as well as contracts for the supply of sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery.

(4) Orders of PURELEI Advent Calendars, PURELEI Surprise Boxes, Influencer Boxes, PURELEI Fashion Boxes, and Jewelry Sets can only be withdrawn in their entirety and must be returned in their entirety. A full refund is made only if the order is returned in its entirety. Rights regarding defects in individual items remain unaffected. Should a product be missing or should individual items be defective, this must be reported to customer service.

(5) The collections of the Mahina Edition are limited and contain exclusive jewelry pieces. The Mahina Club is a monthly subscription; the right of withdrawal exists only after the first delivery and after a new registration following a cancellation.

§9 Voluntary Return Policy up to 30 Days after Receipt of Goods

(1) Without prejudice to the statutory right of withdrawal, the customer is granted a voluntary return policy of 30 days from receipt of the goods according to the following provisions. With this return policy, the customer can also withdraw from the contract after the expiry of the 14-day withdrawal period (see cancellation policy above) without giving reasons by returning the goods within 30 days of their receipt (starting the day after receipt of the goods).

(2) The voluntary return policy exists exclusively for new and unworn goods. Items that have already been worn or washed cannot be returned. The items must be returned in the complete original packaging. An existing original label must be present. If these conditions are not met, the return may be refused.

(3) The voluntary return policy does not apply to the purchase of gift vouchers, advent calendars, and items where something else is expressly determined, the Mahina Club, and goods for which the statutory right of withdrawal is excluded (see cancellation policy above).

(4) The costs for the return of the goods are borne by the customer. The delivery note included in the shipment is not a return label. The completed delivery note is to be included with the return for its processing. If a delivery note is missing, a piece of paper with the name, order number, and possibly reason for the return should be included.

(5) Various orders may be shipped together, whereby the jewelry pieces in the corresponding packaging and all delivery notes or pieces of paper referred to in paragraph (4) must be included with the return. PURELEI Surprise Boxes, Influencer Boxes, PURELEI Fashion Boxes, and Jewelry Sets must be returned in their entirety.

(6) No separate confirmation of receipt is issued upon receipt of the returned goods. Once the return has been processed, the customer receives a notification. The processing time is usually 10 days and can be extended during larger sale promotions.

(7) Refunds are made to the account used for payment. For payments by PayPal, credit card, or Apple Pay, the refund is made to the associated PayPal or credit card account. When purchasing using a gift voucher, a digital gift voucher is issued for the corresponding amount. Information on refunds for payments made with Klarna is listed at the end of the general terms and conditions ("Information on Klarna").

(8) Until the expiry of the period for the statutory right of withdrawal, only the statutory conditions listed there apply. The voluntary return policy does not restrict the statutory warranty rights.

§10 Warranty

The statutory warranty provisions apply unless otherwise specified below.

§11 Limitation of Liability

(1) We are liable to the customer in all cases of contractual and non-contractual liability for intent and gross negligence in accordance with statutory provisions for damages or compensation for futile expenses.

(2) In other cases, unless specified differently in paragraph 3, we are only liable for the breach of a contractual obligation, the fulfillment of which is essential for the proper execution of the contract and on the observance of which the customer regularly relies (so-called cardinal obligation), limited to compensation for the foreseeable and typical damage. In all other cases, our liability is excluded, subject to the provision in paragraph 3.

(3) Our liability for damages from injury to life, body, or health and under the Product Liability Act remains unaffected by the aforementioned limitations and exclusions of liability.

§13 Special Conditions PURELEI LOYALTY:

  1. PURELEI LOYALTY

PURELEI GmbH ("PURELEI") operates the PURELEI Loyalty Program "PURELEI LOYALTY" and manages the loyalty points credited to you for your activities within PURELEI LOYALTY. Every natural person who registers at https://purelei.com/, creates a PURELEI online customer account, and thereby accepts the terms and conditions, automatically participates in PURELEI LOYALTY. Participation is free of charge.

  1. Collecting Points

POINTS can be collected in the PURELEI online store as soon as you have created a PURELEI LOYALTY online customer account.

For every purchase you make in the PURELEI online store after creating a PURELEI LOYALTY online customer account, points are credited to your personal points account at the current valid percentage of your respective purchase value of PURELEI products (excluding returns). No points are awarded for the purchase of (gift) vouchers and for shipping costs.

  1. Redeeming Points

All points earned with your purchases in the PURELEI online store change to active status after 14 days and are then available in your PURELEI LOYALTY online customer account. All other points, e.g., those credited to your points account through special promotions, are directly available in your PURELEI LOYALTY online customer account.

Once you have reached 1,000 released points, you can redeem these directly at checkout. A cash payout of the points as well as a credit towards shipping costs are not possible.

The redemption of points is limited per purchase to 1,600 points = 8€.

Points that have not been redeemed within 12 months of their respective acquisition expire.

  1. Your Status in PURELEI LOYALTY

OAHU BACKPACKER

As soon as you have created a PURELEI LOYALTY online customer account, you automatically attain the Oahu Backpacker status. The Oahu Backpacker status is unlimited in duration and non-transferable.

MAUI EXPLORER

If you have collected at least 1,850 active points, you automatically switch to the Maui Explorer status. Your Maui Explorer status is non-transferable.

HAWAII ADVENTURER

If you have collected at least 4,250 active points, you automatically switch to the Hawaii Adventurer status. Your Hawaii Adventurer status is non-transferable.

MAHINA CLUB GUIDE

If you have purchased an active Mahina Club subscription, you automatically switch to the Mahina Club Guide status. Your Mahina Club Guide status is non-transferable. Upon cancellation of the subscription, you will be reclassified according to your points status into the Oahu Backpacker, Maui Explorer, or Hawaii Adventurer status.

  1. Changes to PURELEI LOYALTY / Participation Conditions, Cancellation, and Termination

PURELEI reserves the right to discontinue, supplement, or modify the PURELEI LOYALTY loyalty program with reasonable notice, or without such notice in the event of an important reason such as changes in legislation, supreme court jurisprudence, or market conditions, while reasonably safeguarding your interests. Furthermore, PURELEI reserves the right to change or supplement the participation conditions if this is necessary for a simple and secure processing, especially to prevent abuses. Changes will be communicated to you either during your login process to your PURELEI LOYALTY online customer account or in advance by email to your specified email address in the PURELEI LOYALTY online customer account. A change is deemed approved if you do not object within one month after receiving the change notification and PURELEI has pointed out this legal consequence in the change notification. If you do not accept these changes or object to the change or supplement, unfortunately, you can no longer participate in PURELEI LOYALTY, and we must block your PURELEI LOYALTY online customer account. PURELEI may terminate and block the PURELEI LOYALTY online customer account at any time for an important reason, e.g., if the participant violates these general participation conditions. §14 Final Provisions

(1) The law of the Federal Republic of Germany applies to contracts between us and the customer, excluding the UN Sales Convention. The statutory provisions limiting the choice of law and the applicability of mandatory provisions, especially of the state in which the customer as a consumer has his habitual residence, remain unaffected.

(2) Should individual provisions of these General Terms and Conditions be invalid, void, or incomplete, the validity of the remaining provisions shall not be affected thereby. The parties will – if necessary in due form – replace the ineffective or void provision with such a regulation, or fill the contractual gap with such a regulation, with which the economic purpose pursued by you can be achieved most closely. If the invalidity or voidness of a provision is based on a measure of performance or time (deadline or date), then a legally permissible measure shall replace the ineffective or void performance or time specification.

Invoice: When purchasing on account with Klarna, you always receive the goods first and always have a payment period of 14 days. The invoice terms can be found here.

Installment Purchase: With Klarna's financing service, you can pay for your purchase flexibly in monthly installments of at least 1/24 of the total amount (at least however 6.95 EUR) or under the otherwise specified conditions in the checkout.
